The Commission in its own jurisprudence and soft law has indicated what
constitutes an effective investigation. The Commission's Guidelines on combating
Sexual Violence and its consequences in Africa, detail the requirements for the
exercise of an effective investigation in cases involving sexual violence.69 With
regard to the investigation of cases of cruel, inhumane and degrading treatment
General Comment No. 4 is instructive. It provides that:

State Parties shall carry out prompt, impartial, independent and thorough
investigations when there are reasonable grounds to believe that torture and other
ill-treatment has been committed, prosecute those responsible, and provide
adequate, effective and comprehensive reparation to victims. Investigations should
be in line with the standards enshrined in the UN Manual on the Effective
Investigation and Documentation of Torture and Other Cruel, Inhuman or
Degrading Treatment or Pimishment (the Istanbul Protocol). " 70

International Human rights law is also instructive in what constitutes an
effective investigation into cases of cruel, inhumane and degrading treatment. The
United Nations Principles on Effective Investigation and Documentation of
Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (UN
Principles on investigation of torture) provide that

"2. States shall ensure that complaints and reports of torture or ill-treatment are
promptly and effectively investigated. Even in the absence of an express complaint,
an investigation shall be undertaken if there are other indications that torture or
ill-treatment might have occurred. The investigators, who shall be independent of
the suspected perpetrators and the agency they serve, shall be competent and
impartial. They shall have access to, or be empowered to commission investigations
by, impartial medical or other experts. The methods;::;--:- to cam; out such
