- A letter dated August 22nd 2011 was received by a registrar at the court, where advocate Marcel Ceccaldi requested an advisory opinion from the court on behalf of the Peoples Libyan Arab Jamahiriya. The court instructed the registrar to ask the author of the request to show proof that he was acting on behalf of Libya, but unfortunately the author declined to respond to this request. The attitude of the author of the request for advisory opinion, showed unwillingness to pursue the matter further. As a result of this behavior, the court unanimously decided to remove the request from the general list of the court.

- ECOWAS Court has jurisdiction over human rights violations under Article 9(4) of its Protocol. Mere allegation of human rights violation is sufficient to confer jurisdiction. The Court is not an appellate body for national court decisions but can hear claims of human rights violations arising from domestic proceedings. Cause of action exists when facts disclose a legal right, even if not yet legally maintained. Admissibility requires claimants to have victim status, not be anonymous, and not have the matter pending in another international court. NGOs with legal personality can represent victims in human rights claims. Senegal, on the other hand, has the right to know why the Court chose to make a solemn ruling on the application by means of a Judgment, rather than reject it de plano with a simple letter issued by the Registry. - In Lacerda Yoann v. Republic of Cabo Verde (Application No. ECW/CCJ/APP/38/23; Judgment No. ECW/CCJ/JUD/17/25, 7 April 2025), the ECOWAS Court of Justice confirmed its jurisdiction and declared the application admissible. The Applicant, a Cabo Verde citizen, claimed that the State violated his right to health under Article 16 of the African Charter, Article 12 of the ICESCR, and Article 25 of the UDHR, by failing to provide access to necessary medicines for his hereditary immunodeficiency. The Court found that the Defendant State had authorized the import of the medicine and provided guidance on accessing it, but the Applicant failed to follow the prescribed procedures. Consequently, the Court held that the Defendant did not violate the Applicant’s right to health, dismissed all other claims as unfounded, and ordered that the parties bear their own costs.

- lt emerges from the file that the Applicant, Oscar Josiah and his wife, were married in 201 1 and were living together at Chankila village in the North West of Tanzania. At the time of their marriage, the Applicant's wife was pregnant by another man but apparently, the Applicant did not have any problem with this situation. The couple stayed together until 2 July 2012 when the wife gave birth to a child. On the same day, it is alleged that the baby died of unnatural causes after having been abandoned in the bush. A subsequent post-mortem medical examination revealed that the cause of the death was Hypoglycemia (lack of sugar in the blood) and Hypothermia (lack of bodily warmth). The Applicant and his wife were later charged with the offence of murder, the High Court acquitted the wife but convicted the Applicant and sentenced him to death. The Applicant subsequently appealed to the Court of Appeal of Tanzania, but the Court dismissed his appeal for lack of merit, in its judgment delivered on 25 February 2016.

Thereafter, in 1999, his wife and children entered the country as refugees - they lived with him in Dar es Salaam. In 2005, the applicant filed a civil case over a dispute with a retail trader. - The Applicants, Mr. Nguza Viking and Mr. Johnson Nguza are citizens of the Democratic Republic of Congo and lived and worked as musicians in Dar es Salaam, Tanzania. The second Applicant (Johnson Nguza) is the first Applicant’s (Nguza Viking) biological son. All applicants were arrested on 12th day of October, 2003 and transferred to the Magomeni Police Station. The Applicants and another person (later known as a teacher) were arraigned before the Resident Magistrate Court of Kisutu (Dar es Salaam) on 16th day of October, 2003 and were charged with 10 counts of rape and 11 counts of sodomy.

SERAP argues it should be recognized by the African Union on the basis that is an African organization that is registered in Nigeria. - ⚖️ Case Headnotes Revision of Judgment – Requirement of a New and Decisive Fact: An application for revision under Article 27 of the Protocol (as amended) must be based on the discovery of a new and decisive fact unknown to both the Court and the applicant at the time of judgment. Legal arguments previously raised and decided do not qualify as new facts. Admissibility – Absence of New Fact Renders Application Inadmissible: Where an applicant merely re-argues issues of jurisdiction, competence, or res judicata that were already decided in the original judgment, the request for revision is manifestly inadmissible. Jurisdiction – Competence of the Court to Entertain Revision: The ECOWAS Court retains jurisdiction to entertain post-judgment applications for revision where the applicant was a party to the original case and alleges discovery of a new fact. Extension of Time – Procedural Discretion: The Court may, in its discretion, grant an extension of time to file an application for revision, especially where the opposing party raises no objection. Non-Compliance with Judgment – Abuse of Process: An application for revision that is filed solely to delay or frustrate compliance with an earlier binding judgment constitutes an abuse of the Court’s process. Implementation of Decisions – Costs Awarded Against Defaulting State: The Court may order a defaulting Member State to bear the costs of the successful party where the revision application lacks merit and delays enforcement of a prior judgment.
