- The Complainant alleges that on 16 December 1998, the Buhera Rural District Council at a Council meeting decided that Samuel T Muzerengwa’s village (hereinafter the “Wakarambwa Village”) was situated in the lands of another village called Nyararai Village headed by Mungofa Gotora. In its decision the Council resolved that the Wakarambwa’s village should immediately move out of the land it occupied. No alternative land was provided even though the decision to evict was reached in terms of the Rural District Act (29:13) which allows the District Councils of each district to allocate land to individuals who are resident or originate from that district, if there is an unoccupied land.

- Sohaib Emad is an Egyptian born on 12 December 1998 and resides in Mansoura City. At the time of his arrest, he was aged 15 and was attending secondary school in AI Terraa Street, in Mansoura City. 4. The Complainants allege that Sohaib took part in demonstrations on the 20141 anniversary of the 2011 January uprising. Consequently on 11 February 2014, Sohaib Emad was arrested at his house without being informed of any charges and taken to Mansoura Police Station.He remained in the police station for 40 days. He had no access to a lawyer and family members for the first four days. He was allegedly subjected to beating including kicks and punches in different parts of his body and face to force him to admit to being a member of a gang involved in, burning police vehicles, possession of Molotov cocktails and targeting police officers and academics to kill them.

- sThe complainants allege that on 1st January 2014, Ahmed was on his way to his friend's house in Jankleez Area in Alexandria, to borrow some notes, when the police forces threw tear gas on a protest nearby his friend's house; Ahmed covered his face with his clothes and ran away from the tear gas; and fifteen minutes later, after his arrival to his friend's house, the state security police came to the building calling on the family to hand the child who just entered the building. They allegedly threatened to break the door of his friend's flat if the "the terrorist was not handed to them" as stated by the forces. 5. Upon entering the flat, the police allegedly grabbed Ahmed by his clothes, slapped him on his face, breaking his glasses before covering his face with his shirt while dragging him to the floor and pushing him to a police van. The Complainants allege that Ahmed was being verbally and physically assaulted at the time of arrest and continued during the journey to the police station.

The communication alleges that the military government of Nigeria has enacted various decrees in violation of the African Charter, specifically the Constitution (Suspension and Modification) Decree No. 107 of 1993, which not only suspends the Constitution but also specifies that no decree promulgated after December 1983 can be examined in any Nigerian Court; and the Political Parties (Dissolution) Decree No. 114 of 1993, which in addition to dissolving political parties, ousts the jurisdiction of the courts and specifically nullifies any domestic effect of the African Charter.

- The communication concerns 11 soldiers of the Nigerian army: WO1 Samson Elo, WO2 Jomu James, Ex. WO2 David Umukoro, Sat. Gartue Ortoo, LCPI Pullen Blacky, Ex LCPI Lucky Iviero, PVT Fakolade Taiwo, PVT Adelabi Ojejide, PVT Chris Miebi, Ex PVT Otem Anang, and WO2 Austin Ogbeowe. They were arrested in April 1990 on suspicion of being part of a coup plot and were tried twice, once in 1990, and once in 1991. They were found innocent on both occasions but still have not been freed. On 31st October 1991, the then-Armed Forces Ruling Council granted them state pardon. However, they continue to be held at Kirikiri Prison under terrible conditions. The complaint argues that there are no further domestic remedies available, since the jurisdiction of the courts over the matter has now been ousted by military decree.

According to the Complainants, between April and September 1996, the Angolan government rounded up and expelled West African nationals on its territory. These illegal expulsions were preceded by acts of brutality committed against Senegalese, Malian, Gambian, Mauritanian and other nationals. Those affected lost in the process their belongings.

- The complainants allege that eleven (11) former Eritrean government officials, namely, Petros Solomon, Ogbe Abraha, Haile Woldetensae, Mahmud Ahmed Sheriffo, Berhane Ghebre Eghzabiher, Astier Feshation, Saleh Kekya, Hamid Himid, Estifanos Seyoum, Germano Nati and Beraki Ghebre Selassie were illegally arrested in Asmara, Eritrea on 18th and 19thSeptember 2001 in violation of Eritrean laws and the African Charter. They were part of a group of fifteen (15) senior officials of the ruling Peoples’ Front for Democracy and Justice (PFDJ) who had been openly critical of the Eritrean Government policies. In May 2001, they wrote an open letter to ruling party members criticising the government for acting in an ‘illegal and unconstitutional’ manner. Their letter also called upon “all PFDJ members and Eritrean people in general to express their opinion through legal and democratic means and to give their support to the goals and principles they consider just”. The government subsequently announced that the eleven individuals mentioned above, on whose behalf the present complaint is being filed, had been detained ‘because of crimes against the nation’s security and sovereignty'.

- The Complainants submitted that on 19 July 2011, the National Assembly of the Republic of Sudan adopted amendments to the Sudan Nationality Act of 1994. These amendments entered into force on 10 August 2011 following signature of the President of the Republic of Sudan. These amendments provide for, among others, the automatic revocation of Sudanese nationality of those who became citizens of the Republic of South Sudan. The amendments further provide that Sudanese nationality shall be revoked where the Sudanese nationality of the responsible parent is revoked because of de facto or de jure entitlement to South Sudanese nationality. According to the nationality laws of the Respondent State, dual nationality with South Sudan is not permitted.

- The complainants, in their submission to the Committee, allege that TFA, aged 10, was raped on the 9, 12, 15 and 16 of April, 2012, in Amanda - North-West region of Cameroon. The violation was then reported by Ms. Tebid Ruthda, the aunt of the victim, who officially filed the case before the local police. The complainants allege that the police requested a medical examination of the victim which included an HIV test. The medical examination confirmed that she had been raped and a medical certificate to that effect was obtained from the hospital by victim‟s aunt.

- The request for Advisory opinion is submitted by the Socio Economic Rights and Accountability Project on the basis of clarifying whether the organization is recognized by the AU. SERAP argues it should be recognized by the African Union on the basis that is an African organization that is registered in Nigeria. SERAP also argues that due to its observer status with the African Commission it has the competence to request an opinion relating to any question within the scope of the ACFPR. But since SERAP doesn’t have a memorandum of understanding with the African union, it isn’t entitled to bring a request for advisory opinion before the court. The Court couldn’t give an opinion on the request due to not having personal jurisdiction.

- They submit that in April 2004, the victims approached the Immigration and Passports Department of the Ministry of Interior to list their three daughters on Ms Enayet’s passport. The Department agreed to add the daughters to their mother’s passport only if the applicants’ put a dash in front of “religion” on the passport application. This was complied with by the applicants and the passport was received. However, in May 2004, the Civil Status Intelligence Unit in Alexandria summoned Ms Enayet. She went with her husband and met with an officer who told them to change the religion entered on their IDs and on their daughters’ birth certificates. Their ID cards were confiscated during the meeting.

However, upon her return to Rewanda (after seventeen years) to contribute to national development by forming a political party, she was remanded, placed under detention and charge with the crime of spreading the ideology of genocide, aiding and abetting terrorism, sectarianism and divisionism, undermining the internal security of a state, establishment of an armed branch of a rebel movement, and attempted recourse to terrorism, armed force and any form of violence to destabilize established authority and violate constitutional principles.

- The Applicant states that he is a convict serving a 30 year custodial sentence at Karanga Central Prison at Moshi, Kilimanjaro Region, the United Republic of Tanzania following his conviction on 3 June 1998. He alleges that there has been an undue delay in consideration of his request for the review of the decision of the Court of Appeal of 29 May 2009 to uphold his conviction and that the the Trial and Appellate Courts erred in law by convicting him. He therefore requests that the Court quashes the decisions by the trial court and the appellate courts convicting him of the offences he was charged with, acquits him and sets him free.
