Rule 7 Incompatibility / Paragraph 1

• Paragraph 1
  The position of member of the Commission is incompatible with any activity that might interfere with the independence or impartiality of such a member or demands of the office such as a member of government, a Minister or under-secretary of State, a diplomatic representative, a director of a ministry, or one of his subordinates, or the legal adviser to a foreign office or any other political binding function or participate in any activity of the nature that will compromise the independence and impartiality.


• Paragraph 2
  The Bureau of the Commission shall ensure that the requirements in Rule 7(1) above are enforced in accordance with Article 31(1) & 2 and 39(2) of the African Charter.


• Paragraph 3
  In the case of incompatibility, the Chairperson of the Commission shall inform the Chairperson of the African Union Commission, who shall declare the seat vacant.
