Rule 101 Inability of a Member of the Commission to Take Part in the Examination of a Communication / Paragraph 1.d
- Paragraph 1
A member of the Commission shall not be present and take part in the consideration of a Communication if he or she: - Point a
is a national of the State Party concerned; - Point b
has any personal interest in the case; - Point c
is engaged in any political or administrative activity or any professional activity that is incompatible with his or her independence or impartiality; - Point d
has participated in any capacity in any decision at the national level in relation to the Communication; or - Point e
has expressed publicly opinions that might be interpreted as reflecting lack of impartiality with respect to the Communication. - Paragraph 2
Any question that may arise under paragraph 1 above shall be decided by the Commission without the participation of the member concerned.
